Peerless has requested that the United States Patent and Trademark Office (USPTO) to re-examine Neutral Tandem's (NASDAQ: TNDM) Patent 7,123,708 on the patentability of the patent in light of numerous prior art reference materials identified as part of the ongoing litigation between the companies. These materials were not considered by the patent office in its review of the original patent application. This action was undertaken in part because Neutral Tandem's broad interpretation of its patent had the potential of ensnaring many companies, ironically including ones that had been operating for many years prior to Neutral Tandem's application for patent protection. Thus, it is in the best interests of the industry as a whole to see that the patent is unequivocally determined to be unpatentable to prevent any future legal abuses.
